By accessing or using KinlyPets (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

KinlyPets reserves the right to modify these terms at any time. We will notify registered users of material changes via email. Your continued use of the Service after changes constitutes acceptance of the updated terms.

2. Description of Service

KinlyPets is a pet health records platform that allows you to track your pet’s health history, including vaccinations, medications, vet visits, and weight. The Service includes an AI-powered symptom checker that provides general health guidance based on information you provide about your pet.

The Service is designed for pet owners to organize health information and receive general guidance. It is not a veterinary practice and does not provide veterinary medical services.

You may use certain features of the Service without creating an account. To access full features including health records, you must register with a valid email address. You are responsible for maintaining the security of your account credentials.

You agree to provide accurate information when creating your account and to keep your information current. You are responsible for all activity that occurs under your account.

5. Subscription Terms

KinlyPets offers both free and paid subscription plans. The free plan includes limited symptom checks per month and basic pet records. Paid plans provide additional features including expanded check limits, health report generation, and increased pet limits.

Paid subscriptions are billed annually at the rate displayed at the time of purchase. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or the Stripe customer portal.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, including pet health data.

You retain ownership of the pet health data you enter into the Service. By using the Service, you grant KinlyPets a limited license to process this data to provide the Service, including generating AI-powered assessments.

7. User Content and Conduct

You are solely responsible for the accuracy of information you provide about your pet, including symptoms, medical history, and health records. Inaccurate information may lead to inaccurate AI assessments.

You agree not to use the Service to transmit harmful, abusive, or illegal content, or to attempt to reverse-engineer, disrupt, or abuse the AI system or any other part of the Service.

8. Intellectual Property

The Service, including its design, features, AI models, branding, and content (excluding user-provided data), is the property of KinlyPets and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without prior written permission.

9. Limitation of Liability

To the maximum extent permitted by law, KinlyPets and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages arising from reliance on AI-generated health assessments.

KinlyPets’s total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Service Availability

KinlyPets strives to maintain continuous availability of the Service but does not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

11. Termination

You may terminate your account at any time through your account settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

KinlyPets reserves the right to suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we determine to be harmful to the Service or other users.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
